This full day event will open for registration at 9.30am and conclude at 5.00pm with a sit-down lunch provided.

The seminar will cover the following:

  • Function specific capacity in practice.
    • A reminder of the capacity tests for the typical transactions that a private client solicitor will encounter (including marriage, gifting, making & revoking wills, contracting, executing an enduring power of attorney and litigation).
  • Assessing testamentary capacity in practice.
    • What are the Solicitor’s obligations and what makes a good attendance note?
  • Powers of Attorney under an enduring powers of attorney v Power of controllers.
    • For what tasks / functions does an attorney / controller require the authority of the Court?
  • Case studies on property related applications under the Mental Health (NI) Order 1986.
    • Applications to the OCP Master to authorize lifetime gifts and other ordering of financial affairs (joint tenancies, partnership assets) and to approve statutory wills.
  • Removing an incapable trustee.
    • What are the options?
  • Case law & legislation update – a review of recent developments.

Speakers:

Sheena Grattan: is a practising barrister.  She specialises in estates and trusts issues, both contentious and non-contentious.  She was formerly a Senior Lecturer at QUB, is the author of numerous texts and articles including Succession Law in Northern Ireland and Drafting Trusts and Will Trusts in Northern Ireland (with James Kessler QC).  She is also the examiner of both legal components for the STEP NI Diploma and is currently chair of the Northern Ireland branch of STEP.

Michael Graham: is a Director in the Private Client Department of Cleaver Fulton Rankin & is a member of the Society of Trust & Estate Practitioners & the Former Chair of its Northern Ireland Branch.  He is also a member of the Executive Committee of Will to Give, a local charity created to promote charitable giving by will in Northern Ireland, and a member of the Solicitors For The Elderly.
